SiriusXM signs multi-year deal with MLB Advanced Media to stream all Major League Baseball games on SiriusXM App and online.
All SiriusXM subscribers will have access to live radio broadcasts of every MLB game on smartphones, mobile devices and online; Games will continue to air on XM satellite radios.
Listeners get all regular season games, the All-Star Game and every Postseason game.

Sirius XM Radio today announced a multi-year agreement with MLB Advanced Media, L.P. (MLBAM), the interactive media and Internet company of Major League Baseball, to stream live radio broadcasts of every Major League Baseball game on smartphones, mobile devices and online for SiriusXM subscribers nationwide.  With this agreement, SiriusXM becomes the Official Internet Radio Partner of MLB.com.

Available immediately, SiriusXM subscribers can listen to live broadcasts of every MLB game through the SiriusXM Internet Radio App and online at siriusxm.com.  Listeners get all regular season games, the All-Star Game and every Postseason game.  Spring Training games will be available starting next year.  Select Spanish-language broadcasts are also available.

SiriusXM Announces Live Broadcast Coverage of 2012 Masters

 

Sirius XM Radio announced today that it will offer subscribers nationwide live hole-by-hole coverage of the 2012 Masters Tournament from Thursday, April 5, through Sunday, April 8, on the SiriusXM PGA TOUR Radio channel (XM channel 93, Sirius channel 208).

SiriusXM PGA TOUR Radio is available to XM subscribers and Sirius Premier (formerly known as “The Best of XM”) subscribers.  The channel can also be heard online on SiriusXM Internet Radio and through the SiriusXM Internet Radio App for smartphone and wireless devices.

SiriusXM Files Antitrust Claims Against SoundExchange and a Record Industry Trade Association

Sirius XM Radio today announced that it has filed a complaint againstSoundExchange, Inc. and American Association of Independent Music (“A2IM”) charging those organizations with unlawfully interfering in SiriusXM’s efforts to secure, through a competitive market, copyrights critical to its business.  The complaint contends that the conduct violates federal antitrust, as well as New York state law.

SiriusXM is primarily seeking injunctive relief to stop SoundExchange and A2IM from impeding its efforts to obtain the licenses it needs to operate its business in direct dealings with record companies instead of relying exclusively on licenses either negotiated with SoundExchange acting as the record industry’s collective or on the outcome of regulatory rate-making proceedings.  The complaint charges that, although SiriusXM has the legal right to reach out to individual record companies for such licenses, SoundExchange, in collaboration with other record industry organizations, has orchestrated an illegal boycott designed to choke off such competition.

SiriusXM’s direct licensing initiative is beneficial to the Company, listeners, artists and record labels.  This filing reflects SiriusXM’s commitment to taking the steps necessary to maintain its rights to conduct business in a free and open market for the benefit of its business, listeners, artists and record companies.

The complaint contends that SoundExchange and other industry trade associations, in concert with numerous individual record labels, have eliminated price competition in, among others, the market for digital transmissions of sound recordings licensable under the statutory licensing provisions of Section 114 of the Copyright Act of 1976.  The complaint further contends that SoundExchange and A2IM, along with major music industry organizations, have organized a boycott to prevent independent record companies from negotiating direct licenses with SiriusXM for sound recordings that are included in the Company’s commercial-free music content.  As outlined in the complaint, there has been an orchestrated effort against labels looking to negotiate directly with SiriusXM, including mailings to members, public statements released to the media and posted on their websites, board level discussions, direct pressure tactics placed on individual labels known to be considering SiriusXM’s offer and even overt efforts to cause one or more entities that actually signed a direct license to rescind it.

As a result of the complained of conduct, SiriusXM has been forced to deal exclusively with SoundExchange to acquire statutory licenses at higher prices than it otherwise would have obtained through direct licensing with individual record labels.  The complaint contends that this conduct and the ensuing boycott violate federal antitrust laws and tortiously interferes in SiriusXM’s business relationships.

SiriusXM has signed nearly 80 direct licenses to date; the Company believes that without the complained of conduct, it would have attained far more.  The Company believes that if SoundExchange, the trade associations and major record labels are allowed to continue this conduct, it is likely that similar anticompetitive harm will result to other rights users who are unable to secure direct licenses to rights.

SiriusXM’s Direct Licensing Initiative
As part of a larger effort to manage through the challenging market environment, SiriusXM has sought to manage the cost of its music programming by negotiating royalty rates directly with individual record labels.  This interest was further spurred by the extraordinary increases in statutory fees that the record industry, through SoundExchange, advised they were seeking beginning in 2013, and SiriusXM’s desire to enter into a single license covering all of its platforms, including satellite, internet, mobile devices and more.  Having one license agreement that encompasses these platforms provides an opportunity for record companies to derive more value than they would by relying on distributions from SoundExchange.  Notably, SiriusXM can enter into a unitary license agreement of such scope only through a direct license; it cannot do so under a SoundExchange statutory license.  Working with a leading provider of high-volume license administration services with deep expertise in the music industry and with similar direct license programs, SiriusXM began developing a comprehensive direct license proposal for record companies in 2010.

The direct licenses, offered at rates between 5% and 7% of defined revenues, would be powerful evidence of prevailing market rates in the pending 2013-2017 CRB proceeding and stand in stark contrast to the much higher rates proposed by SoundExchange in that proceeding.

The complaint was filed in the United States District Court for the Southern District of New York.

SiriusXM and NASCAR to Broadcast Races Online and on SiriusXM App

Sirius XM Radio and NASCAR announced today an agreement to simulcast the programming on the SiriusXM NASCAR Radio channel in its entirety — which includes live broadcasts of every national series race, plus dailyNASCAR talk — online for SiriusXM subscribers nationwide.

Starting with this weekend’s races in Fontana, CA (March 24-25), subscribers who have SiriusXM Internet Radio access can listen to live broadcasts of every NASCAR Sprint Cup Series, NASCAR Nationwide Series and NASCAR Camping World Truck Series race on the SiriusXM NASCAR radio channel through their computers at siriusxm.com and through the SiriusXM Internet Radio App for smartphone and wireless devices.

SiriusXM NASCAR Radio, channel 90, is available to Sirius subscribers, XM Premier (formerly known as “The Best of Sirius”) and SiriusXM Premier subscribers.

SiriusXM to Broadcast Live 2012 FIA Formula One World Championship Events Nationwide

Sirius XM Radio will broadcast every 2012 FIA Formula One World Championship™ race live, offering comprehensive coverage of the sport to listeners nationwide.

SiriusXM’s 2012 coverage begins with this week’s season-opening event, the 2012 FORMULA 1 QANTAS AUSTRALIAN GRAND PRIX inMelbourne, which will air Sunday, March 18 (2:00 am ET).  Every race, all season long, will air live on Sirius channel 94 and XM channel 208, including the 2012 FORMULA 1 UNITED STATES GRAND PRIX in Texas on November 18.  This season marks the return of the FORMULA 1 UNITED STATES GRAND PRIX event, which was last run in 2007.  The race will be run for the first time at the custom built Circuit of theAmericas in Austin.

SiriusXM Offers Every Game Of The 2012 NCAA Division I Men’s Basketball Championship

Sirius XM Radio will broadcast every game of the 2012 NCAA Division I Men’s Basketball Championship, offering subscribers nationwide uninterrupted access to play-by-play of every match-up from the First Four® on March 13 and 14 through the Final Four and National Championship game in New Orleans on March 31 and April 2.

All tournament games will be available to SiriusXM listeners in their entirety, with no blackouts, on Sirius channels 91, 92, 93, 94 and 85 and XM channels 91, 190, 191, 192 and 193. Sirius XM Radio announced today that best-selling author and columnist John Feinstein has joined Mad Dog Radio, the all-sports talk channel available to listeners nationwide on SiriusXM channel 86.

Starting Thursday, March 8, Feinstein will join Bruce Murray to host the newly named Beyond the Brink every weekday from 10:00 am to 2:00 pm ET.  Feinstein and Murray will debut their show at the ACC Basketball Tournament, broadcasting live from Atlanta’s Philips Arena on Thursday and Friday.  Throughout the year, Feinstein and Murray will cover the spectrum of sports on their show, interviewing high profile guests, debating topics and talking with callers nationwide about the headline stories of the day.

“I’ve always enjoyed doing radio because it gives you a chance to talk in detail on a lot of different topics and the chance to do it on SiriusXM on a daily basis with an old friend like Bruce is something I’m really looking forward to taking on,” said Feinstein.  “I’m really grateful to SiriusXM for giving me this opportunity and I think this is going to be a lot of fun.”

Feinstein is one of the nation’s most successful and prolific sports authors, having written 28 books that delve into a wide range of professional and college sports.  His works include the two best-selling non-fiction sports books in history — A Good Walk Spoiled, about life on the PGA Tour, and A Season on the Brink, which chronicled a year in the life of the Indiana University basketball team and its enigmatic coach, Bob Knight, and was later adapted into an ESPN film.  Feinstein’s style takes his readers deep into the subject matter, to places most fans have no access to — locker rooms, coaches’ offices, team planes and bus rides.  With intricate detail, the author vividly depicts life on a championship college basketball team, during an NFL season, on the PGA Tour, inside the Army-Navy rivalry and many other sports themes.

As a columnist, Feinstein has covered many of sport’s biggest events and personalities over the last 35 years.  A 1977 graduate of Duke University, he writes for The Washington Post and Golf Digest and has contributed to Sports IllustratedThe National Sports Daily and theSporting News.
